Legal information
This page explains who ODE is, how we work, and the terms that apply when you buy from us — whether as an individual or as a business. We've kept it as plain as possible while making sure it covers what it needs to. If anything is unclear, write to us at hello@ode-art.com and we'll explain.
About ODE

The works we sell
ODE offers fine art prints and canvases, produced using professional printing techniques and high-end materials. Where indicated, a work is released as a limited edition. The stated edition size represents the maximum number of pieces that will ever be produced in that edition. Selected works may be individually numbered and accompanied by a certificate of authenticity.
We reserve the right to discontinue works, editions, formats, materials or options at any time. This does not affect orders that have already been placed and paid for.
How a work looks in reality
Because every piece is made using physical materials and professional printing processes, slight variations may occur in colour reproduction, texture, surface finish, framing materials, and dimensions within normal production tolerances. These variations are part of fine art production and are not considered defects.
Colours may also appear differently across screens, devices and lighting environments. We do not guarantee exact colour matching between digital previews, your screen, previous orders or future orders. Product images, room visualisations and mock-ups on the website are for illustration only — actual dimensions, proportions and appearance may vary from what you see digitally.
Pricing and VAT
All prices on this website are shown in Euros and include applicable VAT, unless stated otherwise. Shipping costs, where they apply, are calculated at checkout and shown before you confirm payment.
We reserve the right to adjust prices at any time. Price changes do not affect orders that have already been placed and paid for.
For trade and interior projects, separate pricing and VAT terms apply — see For trade and interior projects below.
Ordering and payment
When you place an order through this website, you submit an offer to buy the selected work. A binding agreement is formed once payment has been successfully processed and the order has been accepted by us.
In exceptional cases — such as pricing errors, technical errors, suspected fraud or availability issues — we may need to refuse or cancel an order. If we do, any payment made will be refunded in full.
Trade orders follow a different process — see How a trade order is placed below.
How your work is made
Every ODE work is made specifically for you, after your order has been placed and paid for. Production begins shortly after we receive your payment, which means that once production has started, it generally cannot be paused or cancelled.
We work with carefully selected production and fulfilment partners to manufacture, package and deliver each work. By placing an order, you acknowledge that relevant order details may be shared with these partners solely to fulfil your order.
Shipping and delivery
We ship across the European Union and the US, with shipping included in the price for standard webshop orders, unless stated otherwise. For destinations outside the EU and US, please get in touch at hello@ode-art.com before ordering so we can discuss shipping for you.
Estimated delivery times are typically around 3–6 working days within the EU. These are guidance only and not guaranteed — delivery may take longer depending on destination, customs procedures, carrier performance or circumstances beyond our control.
Risk of loss or damage passes to you once the work has been delivered to the shipping address you provided. Please make sure your shipping and billing details are accurate when you order; we cannot be held responsible for delays, losses or extra costs caused by incorrect information.
Returns and your right of withdrawal
Because every ODE work is made to order — produced specifically for you in the size, material and finish you chose — orders cannot generally be cancelled, returned or exchanged once production has started. For consumer orders, this is a recognised exception to the standard 14-day right of withdrawal under EU consumer law (Article 16(c) of Directive 2011/83/EU on consumer rights, made-to-order goods).
We ask you to review the work, dimensions and material carefully before ordering. If you're not sure, write to us first — we're happy to help you decide.
The statutory right of withdrawal applies to consumers only. For trade and interior projects, see Cancellation and changes to trade orders below.
If something arrives damaged, defective or incorrect
If your work arrives damaged, defective, incomplete, or materially different from what you ordered, please contact us within 14 days of delivery at hello@ode-art.com. Include photographs of the work, the packaging and the shipping label. Once we've verified the claim, we'll arrange a replacement or another appropriate solution at no extra cost.
Caring for your work
To keep your work looking its best, please avoid prolonged direct sunlight, excessive humidity, outdoor installation, and placement near significant heat sources. Natural ageing of materials over time is not a defect.
For trade and interior projects
The following sections apply to orders placed by businesses, designers and interior projects — for example, hospitality, workspaces, healthcare and wellness environments. They sit alongside the terms above, with one exception: where a trade term differs from a general term, the trade term takes precedence for trade orders.
Trade orders are handled through direct conversation rather than the standard webshop checkout. Each project receives its own proposal, with pricing and timeline set per project.
How a trade order is placed
Trade orders are not placed through the checkout on this website. They follow a quoted process: you tell us about the space, the feeling you're after, and the scope. We respond with a written proposal — covering works, materials, quantities, pricing, timeline and any agreed services.
A proposal is a non-binding offer and remains valid for 30 days from the date of issue, unless stated otherwise. A binding agreement is formed once the proposal has been accepted in writing — confirmation by email is sufficient — and ODE has acknowledged the acceptance.
Webshop prices and standard webshop terms do not automatically apply to trade engagements. Trade pricing and conditions are set in the proposal for each project.
Trade pricing and VAT
Trade pricing is set per project, taking into account quantity, materials, customisation and timeline. Volume terms may apply on larger orders and are stated in the proposal.
Unless stated otherwise, trade prices are exclusive of VAT. Shipping, packaging and any agreed installation costs are quoted separately and itemised on the invoice.
For business clients established in another EU member state with a valid VAT identification number, VAT may be reverse-charged under Article 138 of the EU VAT Directive. Please provide your VAT number when accepting the proposal so we can apply this correctly on the invoice. For clients outside the EU, applicable VAT, import duties and taxes are the responsibility of the client.
Payment terms
Invoices are issued upon written acceptance of the proposal, and at agreed milestones for larger projects. The standard payment term is 30 days from the invoice date, unless otherwise agreed in writing.
For larger projects, or where commissioned work is involved, a deposit may be required before production starts. The deposit amount, the balance and the payment schedule are stated in the proposal.
Late payment may incur statutory commercial interest under the Dutch Wet handelstransacties, together with reasonable collection costs. Production and delivery may be paused or rescheduled where payments are overdue.
Commissioned work
Commissioned work is work created specifically for a project — for example, a piece in a non-standard size, a different colour palette, or a new image entirely. Commissions are agreed through a separate written brief setting out the scope, dimensions, materials, timeline and intended location.
A non-refundable deposit of 50% of the agreed price is payable upon written acceptance of the brief. The balance is due on delivery, unless otherwise agreed.
ODE retains all intellectual property rights, including copyright and reproduction rights, in commissioned work. The client receives a perpetual, non-exclusive licence to display the commissioned work in the agreed location or locations. Resale of the physical work is permitted; reproduction, modification, or use of the work in marketing, publications or further commercial contexts requires separate written consent from ODE.
Revisions are included within the scope agreed in the brief. Significant changes to scope, dimensions or concept after the start of production may be quoted as additional work and confirmed before they are carried out.
Cancellation and changes to trade orders
A proposal can be cancelled by either party at any time before written acceptance, with no cost.
After acceptance and before production starts, the client may cancel against payment of a fair pro-rata fee for work already done — including design, sourcing, planning and reserved production capacity. Any deposit is applied against this fee.
Once production has started, cancellation is not possible and the full agreed price is payable. For commissioned work, the deposit is non-refundable in all cases of cancellation by the client.
Changes to a confirmed order — for example, to sizes, materials, quantities or delivery dates — may incur additional costs and adjusted timelines. Such changes are quoted separately and confirmed in writing before they are implemented.
Delivery and installation for trade orders
Standard trade delivery is to the building entrance or loading bay at the agreed address, unless otherwise stated in the proposal. The client is responsible for ensuring that the receiving site is ready and accessible, and that someone is available to receive the delivery on the agreed date.
Installation, hanging or on-site placement is not included by default. Where required, it can be arranged as a separate scope and is quoted in advance, including any travel and on-site costs.
Delivery dates are best estimates based on production and shipping conditions at the time the proposal is accepted. ODE communicates expected timelines clearly and will inform the client promptly of any material change.
Acceptance and claims for trade orders
The client has 7 working days from delivery to inspect the works and notify ODE of any visible defects, damage or non-conformities. Notifications should be sent to hello@ode-art.com with photographs of the work, the packaging and the shipping documents.
After this inspection period, the order is considered accepted. Hidden defects that could not reasonably have been identified during inspection remain covered under Dutch law for a reasonable period after delivery.
For valid claims, ODE will arrange replacement, repair or another appropriate solution at no additional cost. Where a replacement is not feasible, a partial or full refund may be agreed.
Intellectual property
All works, images, designs, text and other content published by ODE remain the exclusive intellectual property of ODE unless stated otherwise. When you buy a work, you become the owner of that physical piece. No copyright, reproduction rights or other intellectual property rights are transferred. The work may not be copied, reproduced, distributed, modified or commercially exploited without our prior written permission.
For commissioned work, additional intellectual property terms are set out in Commissioned work above.
Liability
To the fullest extent permitted by applicable law, our total liability is limited to the price paid for the work giving rise to the claim. We are not liable for indirect or consequential losses, loss of profits, loss of business opportunities, or losses arising from circumstances beyond our reasonable control.
Nothing in this section limits any liability that cannot be excluded under applicable law — including, for consumers in the EU, statutory rights.
Circumstances beyond our control
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, strikes, carrier disruptions, supply chain interruptions, customs delays, governmental actions, and failures of production or logistics partners.
Privacy
We handle personal information in accordance with our Privacy & Cookie Policy.
Governing law
These terms are governed by the laws of the Netherlands. Any disputes will be brought before the competent courts of the Netherlands, unless mandatory consumer protection laws provide otherwise.
